This is an English translation provided for convenience. If there is any discrepancy, the Hebrew version prevails.
1. General
The website gako-ks.co.il, including all its pages, forms and content (the "Site"), is operated by Gako Kitchen Services Ltd., company no. 514345677, 74 Harosheth Street, Kiryat Bialik, trading as GAKO Air Solutions (the "Company", "we", "us").
These terms govern the relationship between the Company and any person or organisation that visits, browses, submits details through, or otherwise uses the Site (the "User", "you"). Section headings are for convenience only and carry no interpretive weight.
2. Acceptance
By accessing and using the Site you accept these terms in full, together with the Privacy Policy and the Cookie Policy, which form an integral part of them. If you do not accept the terms, please do not use the Site.
Where these terms conflict with a signed agreement between the Company and a client, the signed agreement prevails for that engagement.
3. Purpose of the Site and status of its content
The Site is an information and marketing tool. It describes the Company's fields of activity, the services and products it supplies, and technical content on exhaust systems, air filtration and standards.
The technical content on the Site, including guides, standards pages, requirement tables and technical explanations, is general information only. It is not engineering, safety, legal or design advice, is not a specification for execution, and does not replace an inspection of a specific system at a specific site by a qualified professional.
Laws, standards and the requirements of the authorities, including the Israel Fire and Rescue Authority, the Ministry of Environmental Protection, the Ministry of Health and local authorities, change from time to time and differ between businesses and sites. The requirements that apply to a given User are set by their business licence, the permits issued to them and the instructions of the competent authority, not by this Site.
The Company makes reasonable efforts to keep the content accurate and current but does not guarantee it. Reliance on any content on the Site is at the User's sole responsibility.
Photographs, drawings and renderings on the Site are illustrative. The system actually installed is determined by survey, measurements and site conditions.
4. Permitted use
You may make reasonable personal and business use of the Site to obtain information about the Company and its services and to contact it.
Without the Company's prior written consent, you may not:
- copy, reproduce, distribute, publish or commercially exploit the Site's content or any part of it;
- collect content or data from the Site by automated means, including robots, crawlers or scraping tools, or use the Site's content to train models or computer systems;
- place an unreasonable load on the Site, attempt to penetrate it, circumvent security mechanisms, or probe it for vulnerabilities;
- submit false details, another person's details without their authorisation, or offensive, threatening or unlawful content;
- use the Site in breach of any law, in a way that infringes third-party rights, or to market or send mailings to the Company or its clients.
The Company may block access to the Site for anyone who breaches these terms, without prejudice to any other remedy.
5. Enquiries, quotes and engagement
The forms on the Site and the call and WhatsApp buttons are for making contact only.
Submitting details on the Site does not create a binding engagement, does not order a service and does not oblige the Company to provide any service. The Site offers no online sales or payment processing.
Information about services and products on the Site is not an "offer" in the contractual sense. An engagement is formed only after a survey or enquiry, a written quote from the Company and the client's written acceptance, subject to the terms of that quote.
Prices are not published on the Site. Every price is set according to the survey, scope of work, access conditions, service frequency and schedule.
Urgent matters should be raised by phone, not through the form.
6. Service commitments published on the Site
The service commitments shown on the Site apply on the following terms:
A site survey within three working days and a detailed quote within 24 hours of the survey: these apply to plants, institutional kitchens and businesses, from receipt of a complete enquiry including contact details, the site address and a description of the need, subject to scheduling with the client, site access and normal working days. The count excludes Saturdays, public holidays, statutory rest days and days of reserve duty, and does not apply during periods of emergency instructions.
Warranty on fans and motors: one year on a new fan and motor, and three months on a replaced fan, from the date of installation. The warranty requires reasonable use and installation by the Company, and does not cover normal wear, damage caused by incorrect operation, neglected maintenance, power outages or voltage disturbances, water damage, natural events, or work carried out by anyone other than the Company.
System performance warranty: for as long as the system is under an active maintenance contract with the Company, provided that services are carried out on schedule.
Commitments that do not appear on the Site or in a written quote do not bind the Company. The Company may update these commitments from time to time; the binding wording is the one shown on the Site or in the quote at the time of engagement.
7. Certificates, standards and Form 16
Form 16 (the Israeli kitchen-exhaust cleaning certificate) and other certificates issued by the Company relate to the work actually performed, on the date it was performed, and to the agreed scope. They do not certify the condition of other systems on the premises, including automatic suppression, fire detection, electrical, gas or structural systems.
Granting a business licence, fire-safety approval or any other permit is solely within the authority's power and outside the Company's control. The Company does not guarantee any outcome with any authority.
Any membership, accreditation or professional training shown on the Site refers to the date of publication. The accrediting body may change its status.
8. Privacy and personal data
Personal data is handled in accordance with the Privacy Policy and the Israeli Protection of Privacy Law, 5741-1981, including Amendment 13 and the Protection of Privacy (Data Security) Regulations, 5777-2017.
In brief:
- Providing details on the Site is voluntary. There is no legal obligation to do so, but without them we cannot respond to your enquiry.
- Data is collected to respond to you, provide the requested service, manage the business relationship and meet legal obligations.
- Data is shared with service providers that operate the Site, form handling, email and enquiry management on the Company's behalf, and with others as set out in the Privacy Policy. It is not sold or passed to third parties for their own use.
- The Company is the data controller. Contact details for any privacy matter appear in section 16 below.
- Everyone has the right to access the data held about them and to request its correction or deletion, under sections 13 and 14 of the Law. Requests are answered within the statutory time limits.
- Please do not submit sensitive data such as medical information or ID numbers. It is not needed for an enquiry.
9. Marketing messages
The Company does not send advertising messages without explicit, separate consent, as required by section 30A of the Communications (Telecommunications and Broadcasting) Law, 5742-1982.
Operational messages relating to an enquiry or an ordered service, such as scheduling, a reminder before a planned visit, or sending a report or invoice, are not advertising.
Anyone who has consented to receive updates may withdraw that consent at any time by replying through the same channel or by writing to the Company's email address. Withdrawal will take effect promptly and no later than the statutory deadline.
10. Cookies
The use of cookies and measurement technologies on the Site is described in the Cookie Policy. Measurement tools that require consent are not activated before consent is given, and consent can be withdrawn at any time.
11. Intellectual property
All intellectual property rights in the Site, including its design, structure, source code, text, guides, photographs, drawings and illustrations, as well as the names GAKO and GAKO Air Solutions and the logo, belong to the Company or to third parties that have licensed them to it.
They may not be copied, reproduced, published, translated, modified or used to create derivative works, in whole or in part, without prior written consent.
Third-party trademarks, trade names and logos, where shown, belong to their owners and appear only with their owners' permission. If you believe content on the Site infringes your rights, please contact the Company and the matter will be reviewed promptly.
12. Third-party links and content
The Site may contain links to third-party websites and services, including maps, WhatsApp and documents published by authorities. These links are provided for convenience only.
The Company has no control over, and is not responsible for, their content, availability or privacy practices. Once you move to an external service, its terms and privacy policy apply.
13. Availability and changes
The Company may change the Site's structure, content, the services shown on it and its availability at any time, or discontinue it, at its discretion and without prior notice.
The Site is provided as is. The Company does not warrant that it will operate continuously or without faults or interruptions, that it will be immune to unauthorised access, or that files downloaded from it are free of harmful components.
14. Limitation of liability and indemnity
Subject to applicable law and to the fullest extent it permits:
- The Company is not liable for any direct, indirect, consequential or special damage or loss of profit suffered by a User or a third party as a result of using the Site, relying on its content, or being unable to use it.
- The Company is not liable for faults, delays or disruptions originating in the internet, infrastructure providers or force majeure.
- To the extent the Company is nonetheless liable in connection with the Site, its liability shall not exceed the amount actually paid to it by the User for the service in dispute in the year preceding the event.
- Nothing in this section limits the Company's obligations to its clients under their engagement agreements, or any liability that cannot be limited by law.
A User who breaches these terms or uses the Site unlawfully shall indemnify the Company for any damage, expense or loss it incurs as a result, including legal fees and costs.
15. Accessibility
The Company works to make the Site accessible. Details of the accessibility level, known limitations and how to contact us are in the Accessibility Statement.
16. Governing law, jurisdiction and contact
These terms and anything arising from them are governed exclusively by the laws of the State of Israel. The competent courts of the Haifa District have exclusive jurisdiction.
If any provision is held invalid or unenforceable, the remaining provisions remain in force.
The Company may update these terms from time to time. The binding version is the one published on the Site, with the date of the last update shown at the top of the page. Continued use of the Site after an update constitutes acceptance of the updated terms.
